SDVOSB Certification Under the SBA

When the following conditions are met, the contracting officer has the authority to set aside acquisitions that exceed the micro-purchase threshold for competition restricted to service-disabled veteran-owned small business concerns. These conditions include the following:

  • Offers will be received from two or more service-disabled veteran-owned small
    business concerns; and
  • The award will be made at a price that is fair to the market.

If the contracting officer gets just one acceptable offer from an SDVOSB in response to
a set-aside, the contracting officer need to allocate the award to the SDVOSB that
received the sole acceptable offer.

Sole Source Awards to SDVOSB

Contracting Officers can issue sole source solicitations to qualifying Service-Disabled Veteran-Owned Small Businesses using the SDVOSB vehicle.

There is a maximum award of three million dollars for services, including options. In accordance with 13 CFR 125.20 and FAR 19.14

Assists individual commands and the Department of Defense in meeting the SDVOSB contracting targets that were established by Executive Order 13360 and the Veterans Entrepreneurship and Small Business Development Act of 1999 (Public Law 106-50).

An annual government-wide goal of not less than five percent of the total value of all prime contract and subcontract awards for participation by small business concerns owned and controlled by service-disabled veterans was established by the Veterans Entrepreneurship and Small Business Development Act of 1999 (Public Law 106-50). This goal was established in order to encourage veterans to engage in commercial enterprise.

In accordance with Section 308 of the Veterans Benefits Act (VBA) of 2003 (Public Law 108-183), a sole source and set-aside procurement program was established for service-disabled veteran-owned small business organizations.

The SDVOSB policy is strengthened by Executive Order 13360, which directs federal agencies to establish plans to implement the policy. This order also reinforces Public Law 106-50 and 108-183.
